In Texas can I get my daughters car out of impound while she is in jail?
My daughter was pulled over for speeding 300 miles from home and arrested due to a bad check warrant back here in a neighboring county, of course the vehicle I bought for her was impounded. Needless to say I am sure the registration has expired as well. She cannot bond out of jail due to extradition back to the county of the warrant, I wont pay her fines and she will have to remain in custody until it's paid which will probably be awhile. Meanwhile the $3000 car I bought her 8 months ago sits 300 miles away at the impound facility racking up fee's which is understandable. There are no liens as I paid cash for it and it was registered in her name at the time. I am willing to pay the fee's and drive all the way to get it and haul it back home and sell it versus loosing the $3000 investment I made that she has now lost due to her irresponsibility and selfishness. Can anyone advise me if and how I can get the car back? Can I have her sign a waiver of some sort or power of attorney etc. I am not at all familiar with towing or vehicle impounds are handled and have been told by a friend that they think that only the legal owner (ie: registered owner/leinholder), can do this. Is this really the case? There has got to be some way I can get it back with her consent or signature while she is incarcerated! I have searched for hours and hours and even read the transportation codes and I just cant find an answer. Can someone Please help!
